New York is getting much tougher on unsafe driving. Beginning in February 2026, major changes to the DMV point system will make it easier for drivers across Central New York and the rest of the state to lose their license faster.

The DMV is rolling out a stricter point system that lowers the number of points you can accumulate before facing suspension… and raises the points attached to some of the most common traffic violations.

Under the new rules, your license can be suspended with just 10 points in 24 months.
Before, the rule was 11 points in 18 months. That means fewer points available to lose, and more time for those points to stack up.
Here's What's Changing
Below is a breakdown of the biggest updates. Many of these increases may surprise you, especially if you rely on “pleading a ticket down” to avoid points. That tactic won’t work anymore.
Increased Points for Existing Violations
Speeding 1–10 mph over the limit: 4 points (up from 3)
Using a cell phone while driving: 6 points (was 5)
Failure to yield to a pedestrian: 5 points (was 3)
Reckless driving: 8 points (was 5)
Speeding in a construction zone: Even 1–2 mph over now adds more points
Construction zones are a major focus of the new system, with the DMV cracking down harder on violations in those areas.
New Violations That Now Carry Points
Some violations that never earned points before now do, and they can add up quickly. That means even if you plead down, you may still face points on your license.
Equipment issues (broken taillights, defective headlights): 1 point each
Illegal U-turns: 2 points
Obstructing traffic: 2 points
Failure to move over for emergency vehicles: 3 points
Why the Change?
The DMV says the overhaul is about safety and aligning New York’s system with neighboring states. But legal experts say there’s also a financial angle: more points may lead to more fines and more drivers agreeing to costly plea deals to avoid high-point convictions.

New Rules for DWIs
The updated system also cracks down harder on impaired driving. The DMV can now permanently suspend a driver’s license after more than four DWI convictions.
When Does All This Begin?
New York State is currently overhauling its entire DMV computer system. The new technology goes live in mid-February 2026, and the stricter point system is expected to launch at the same time.
