Kirk Rothrum is the man filing the lawsuit against Sony Music saying they used samples from his library without paying him, and without even asking permission. Rothum is the owner of bangin-beats.com, which is an online company that offers sound production pieces for musicians.

He says Sony Music took a sample of a woman moaning off his website and used it for Spears' hit 'Piece of Me.' According to TMZ,

Rothrum says he was cruising around listening to the radio when he first heard the offending moans repeated during Brit's 2007 musical masterpiece...

...you can hear them 3 times in the first 10 seconds of the song, and also at the end of each chorus.

Syracuse.com reports that the production music company is based in the Syracuse suburb of Brewerton. Below is the music video for the song in question from Britney Spears.
